The Trustee that runs the Scheme, Plumbing Pensions (UK) Ltd, has made a petition to Court of Session in Edinburgh to seek directions. The Trustee has asked the court whether it can continue to use Scheme funds for section 75 employer debt matters.
Section 75 employer debt legislation is complicated and says that employers must pay an exit charge when they leave the Scheme. The Scheme was not able to calculate employer these exit charges until recently because the legislation was not easy to apply and it was very difficult to get all the data needed.
